The legal definition of "Ready, Willing and Able" (which is what the estate agent should be quoting in their contract) is: “READY, WILLING AND ABLE PURCHASER. A purchaser is a “ready, willing and able” purchaser if he is prepared and is able to [exchange.

  3. Jun 16, 2021 · 16 June 2021 at 8:26PM. Do NOT sign a contract where your agent takes a fee for finding you a ready willing and able buyer. You want a no sale no fee contract - ie only pay the fee if and when you exchange. Otherwise you have to pay the fee to the agent just for finding the buyer, even if it doesn't proceed to exchange. Ask the agent to change it.

  10. Apr 6, 2011 · There are 2 clauses in the terms and conditions I am unhappy with. 1 - If the agent provides a ready, willing, and able purchaser, and I agree the sale, but then pull out (for whatever reason) then I still must pay the fee of the agent - even though the sale has not exchanged contracts. 2 - the agent wishes to have Sole Selling Rights, rather ...
