May 8, 2023 · A proposed class action lawsuit claims the operators and affiliates of online lenders Evergreen Services and LDF Holdings, LLC are engaged in an illegal “rent-a-tribe” scheme whereby they have issued to Illinois residents loans with unlawful interest rates.

Tribal lending entities (TLEs) retained the LLCs to manage their online lending programs. In 2017, the relationships began to deteriorate. The LLCs and their managing members, the Koettings, allegedly persuaded customers to continue borrowing from new lenders controlled by the Koettings.
Two companies entered contracts with an Indian tribe to manage the tribe’s online lending operations. Dan and Mark Koetting were respectively the president and the managing partner of the two companies. Neither of the Koettings was a signatory to the contract’s arbitration agreement.
