Episode Five is the fifth episode of the second season of American Crime.

After Eric is forced to openly discuss his sexuality, Taylor must defend his actions on the night of his alleged assault; Anne struggles with the discovery that her son is gay; a critical decision by detectives makes some involved feel as though the worst may be over.

When the police speak to Taylor about the emails and texts between him and Eric, Taylor admits that he had sex one time before the basketball party and he sent the texts to Eric, but he never gave Eric permission to rape him. Taylor said that he was drugged, Eric put something in his mouth to quiet him and Eric left Taylor to crawl out on his own. He texted Eric to try to get him to talk about it.

Eric claims that Kevin invited Taylor to the party, but didn't know that Taylor was gay and says that Taylor wanted to have sex at the party because "it turned [Taylor] him on to do it kind of public." He also says that Taylor may have been drunk, but knew what was going on & that he wasn't drugged. Then, Eric says that Taylor got too drunk afterwards, so he drove him home.

When Anne questions Taylor about his first sexual encounter, Taylor tells her that it occurred in the 8th grade with a friend who used to sleep over at the Blaines' house, but they never did anything there. Anne ends up taking the confrontation a little too far, making statements that sound like victim-blaming about Taylor's text messages and Taylor walks off.

Meanwhile, Leslie meets with Steph, who is doing photography for an upcoming gala and suggests to her that Coach Sullivan should tell the boys on the basketball team to "do what's right in their hearts" and make sure they attend the gala.

During a scene in which Kevin meets with his basketball teammates, who clearly still know a thing or two but they say that "none of us are going to say anything to the police."

During a therapy session, Taylor believes that he has wasted his time telling what happened and becomes protective of his mother, saying, "I feel more alone than when this started."
