1. Past or present doesn't much matter. What matters more is relative duration. "At" works better for something brief. "In" works better for something that lasts. "A moment" is probably shorter than a stretch of years, but not necessarily if in comparison to centuries or eons.
At the moment is used to mean at present, at this time, at this second. So if someone asked whether you wanted to go for a walk you might well reply: Not at the moment, thank you. However, you might well be in the mood for a walk later. For the moment is an expression that means for now.

It's hard to construe a sentence with "illegal in that time".. hm..

Obviously, I normally use when anyway, but it's usually at the point in time if I have to use the longer form. Except in "scientific" contexts like at the point of time T (that's almost 7000 of them in Google Books).
